Who we are

Virtastic recompiles native desktop software to run in the browser. These terms cover this website, the free application ports we publish, and enquiries about paid work. By using the site or the ports, you agree to them.

The free ports

Our application ports are free and open source, released under the licence stated in each project's repository (typically GPLv3, matching the upstream project we build on). Those licences govern the software itself, including your rights to use, modify and redistribute it. Where these terms and a project's open-source licence conflict, the licence wins.

You supply your own data

We do not distribute commercial game data, application data or other third-party content. Some ports require you to supply your own legally-obtained copy of the original software. You are responsible for having the right to use any files you load, and for complying with the licence that came with them.

By default, a port reads your files locally in your browser using the File System Access API. Read that way, your files stay on your device and are not uploaded to us.

Optional cloud storage

Some ports also offer optional storage, so you can use the same files on more than one machine without setting them up again. This is a personal backup locker for files you already own, and using it is always your choice — every port works without it.

When you use it, the files you upload are stored at your direction and:

• are kept private to your account, and are never shared with or served to another user;
• are stored as your own copy, never pooled or de-duplicated with anyone else's;
• are streamed back only to you, signed in to the same account, through links that are not public;
• can be exported or deleted by you at any time.

You grant us only the limited permission needed to store those files and stream them back to that same account. We make no other use of them. When you upload, you confirm that the files are your own backup copies of software you legally acquired; uploading material you do not own breaches these terms.

We terminate the accounts of repeat infringers in appropriate circumstances, and delete the stored files of any account terminated on those grounds.

Trademarks and affiliation

Product names, game titles and trademarks referenced on this site belong to their respective owners. We are not affiliated with, endorsed by, or sponsored by any of those rights holders. The engines we build on are independent open-source projects created by their own communities, and we credit them in each write-up.

If you are a rights holder with a concern about anything published here, or about a file a user has stored with us, tell us through the contact form and we will respond promptly. Identify the material and where it appears so we can locate it.

Acceptable use

Don't use this site or our ports to break the law, infringe someone else's rights, distribute malware, or attack, overload or disrupt our infrastructure or anyone else's.

No warranty

The site and the free ports are provided as-is and as-available, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. They are hosted as a free service and may change, break or be withdrawn at any time. Nothing here is guaranteed to be uninterrupted or error-free, and you use them at your own risk. Keep your own backups of anything you care about.

Limitation of liability

To the fullest extent permitted by law, Virtastic is not liable for any indirect, incidental or consequential damages, or for any loss of data, profits or goodwill, arising from your use of this site or the free ports. Nothing in these terms limits liability that cannot be limited by law.

Donations

You can support the project through Ko-fi or Patreon. Donations pay for the servers the apps run on and the development time behind them. They are voluntary gifts, not a purchase.

Supporting us buys nothing. There is no paid tier, no subscription and no paywall. Every app, every mode and every feature is free to everyone who turns up, whether they have given us money or not. No amount of support grants access, unlocks a feature, increases how much you can store, changes how your files are handled, or moves you up any queue. We do not charge for storage, streaming, or entry to anything. This is a permanent condition of how the project is built, not a launch promotion.

Paid work

Enquiries made through the contact form or a booking do not create a contract. Paid engagements are governed by a separate written agreement covering scope, deliverables, ownership and payment. Commissioned work is separate from the free apps, and does not change anything above.

Bundled third-party content

Some ports ship a small amount of third-party content — for example community-made performance optimisations that replace files in a copy of the game you already own. That content is not ours, is not covered by the open-source licence of the engine, and remains subject to its authors' own terms. It is included with their permission and credited in the project's THIRD-PARTY-LICENSES file. It does nothing unless you supply your own copy of the original software.

Privacy

How we handle data on this site is covered in our privacy policy.

Changes

We may update these terms. The date at the top reflects the current version, and continuing to use the site means you accept the version in effect.

Governing law

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules. Nothing here removes any protection or right you have under the mandatory law of the country you live in.
